The labor dispatch business license is a statutory qualification for labor dispatch units. License renewal and modification directly affect whether an enterprise can continue lawful operation.
Labor dispatch business licenses are valid for 3 years. To renew upon expiration, an application must be submitted to the licensing authority 60 days before expiration, including basic operating conditions over the past 3 years. Late submissions will not be renewed. The licensing authority decides whether to grant renewal within 20 days of receiving the application.
Changes to the labor dispatch unit's name, address, legal representative, or registered capital require a modification application to the licensing authority. Modification applications require the updated business license, shareholder meeting resolution, articles amendment, and other materials. Entities continuing labor dispatch business after division or merger must reapply for administrative permission.
Labor dispatch units must submit an annual labor dispatch operation report to the licensing authority by March 31 each year, including: operating conditions, number of dispatched workers and labor contract status, remuneration payment to dispatched workers, social insurance participation, and receiving units and dispatch numbers for dispatched workers.
Labor dispatch may only be used for temporary, auxiliary, or substitutable positions. Receiving units may not use dispatched workers exceeding 10% of their total workforce. Labor dispatch units must sign fixed-term labor contracts of 2+ years with dispatched workers and pay remuneration monthly (at minimum wage standard during periods without work). Establishing a labor dispatch unit to dispatch workers to one's own unit or affiliated units is prohibited.
