ICP Business License Application Conditions and Full Process Guide

For-profit internet information services must obtain an ICP business license, a foundational qualification for compliant operation of internet enterprises. Accurately distinguishing ICP filing from ICP licensing is the first step.

1. ICP Filing vs. ICP License

ICP filing (domain name information filing) is a mandatory procedure for all websites hosted on servers within China, processed through the MIIT filing system, free of charge. The ICP business license (Value-Added Telecommunications Business License — Internet Information Service) is an administrative permit for commercial websites, approved by the provincial Communications Administration. Non-commercial websites only need filing; commercial websites need both filing and a license.

2. Application Conditions

The operator must be a lawfully established company; minimum registered capital of RMB 1 million (subscription acceptable); have funds and professional personnel commensurate with business activities; have the reputation or capability to provide long-term service to users; have necessary premises, facilities, and technical solutions; and the company, its major investors, and key management personnel must have no violations of telecommunications supervision regulations in the past 3 years.

3. Application Documents

Required submissions: business license copy, company articles of association, shareholder proofs (business license for corporate shareholders, ID for natural persons), IDs and resumes of legal representative and key management personnel, social security proof (3 persons, last 3 months), domain name registration certificate, server hosting agreement, website plan (including business introduction, technical plan, security plan), and industry pre-approval documents (if involving news, publishing, education, healthcare, etc.).

4. Approval and Annual Reporting

Process: submit application online → Communications Administration acceptance → review (within 60 days) → license issuance. Licenses are valid for 5 years; renewal must be applied for 90 days before expiration. License holders must submit annual reports through the telecommunications business market comprehensive management system each January–March. Changes to company name, legal representative, registered capital, etc., require license modification.
