Food Business License Application Conditions and Process Detailed Guide

Engaging in food sales and catering services requires a food business license obtained in accordance with law. Understanding application conditions and processes helps enterprises obtain licenses efficiently and avoid repeated remediation.

1. Scope of Application

Anyone engaged in food sales and catering services within the People's Republic of China must obtain food business permission. Food business categories include: prepackaged food sales, bulk food sales, special food sales (health food, food for special medical purposes, infant formula, etc.), other food sales, hot food preparation and sale, cold food preparation and sale, raw food preparation and sale, pastry preparation and sale, and self-made beverage preparation and sale.

2. Application Conditions

Applicants must have premises for food material handling, processing, sales, and storage commensurate with the type and quantity of food; equipment or facilities commensurate with the food type and quantity; full-time or part-time food safety management personnel and food safety assurance policies; and a rational equipment layout and process flow.

3. Application Documents and Process

Document checklist: food business license application form, business license or other entity qualification proof, legal representative ID, food safety manager ID, premises floor plan, operational process documents, and food safety management system. Process: submit application online → document acceptance → on-site inspection (within 5 working days) → approval decision (within 10 working days) → collect license.

4. Modification and Renewal

Food business licenses are valid for 5 years. Changes to license particulars require modification application within 10 working days. Changes in business premises require reapplication. Renewal must be applied for 30 working days before expiration. Enterprises are advised to plan renewal timelines in advance to avoid operating without a license. Online food sales must be noted as "online operation" on the license.
